Superfund Cleanup
Remediating Sites with CERCLA Liabilities

In 1980, Congress passed the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), better known as the Federal Superfund Act or simply Superfund. This law gave the federal government the authority to respond to chemical emergencies and to clean up uncontrolled or abandoned hazardous waste sites.

The Superfund program addresses both short and long term pollution risks, from threatened releases to past toxic chemical spills to the permanent cleanup and rehabilitation of abandoned hazardous waste sites.  

Superfund also empowers federal authorities to prosecute those responsible for the releases of hazardous waste. The United States Environmental Protection Agency (USEPA) sets up and manages a trust fund to subsidize cleanup when no responsible party can be identified, as allowed by additional authorities.

Project Diversity
BB&J has represented potentially responsible parties (PRPs) at single-party and multi-party sites. The firm has also worked closely with PRP Steering Committees to resolve issues. BB&J has worked with these PRPs and USEPA during all stages of Superfund removal action and remedial action projects.

BB&J’s CERCLA experience includes the following projects: (1) site assessments and treatability studies, (2) preparation of site-specific project plans required by agencies (e.g., Work Plans, Quality Assurance Project Plans, Air Monitoring Plans, Health and Safety Plans), and (3) technical review of remediation strategies prepared by third party consultants.  

BB&J has worked on a variety of Superfund sites that includes these locations: (1) former military installations, (2) former petroleum refining facilities, (3) former and active manufactured gas plant sites, (4) former and active chemicals manufacturing plants, (5) former explosives manufacturing plants, and (6) abandoned hazardous waste treatment facilities.
